# Scenepond API 用户协议

## 1. 服务、运营与联系
Scenepond API 是由个人运营的 AI 模型 API 接入服务，服务网站为 https://open.scenepond.ai，客服及举报邮箱为 [api-support@scenepond.ai](mailto:api-support@scenepond.ai)。本协议适用于该 API 服务、账户和一次性余额充值。Scenepond 主站的画布、积分套餐或订阅是不同产品，不自动适用本协议。
使用者须年满 18 周岁并具备订立合同的能力；代表组织使用时须获得组织授权。注册或使用前请阅读本协议、[隐私政策](https://open.scenepond.ai/zh/privacy-policy)、[退款政策](https://open.scenepond.ai/zh/refund-policy)和[内容使用政策](https://open.scenepond.ai/zh/acceptable-use)。不同意相关规则时应停止注册和使用。
## 2. 账户与 API 密钥
提供准确的账户资料，妥善保管密码、会话及 API 密钥，对通过账户发起的授权使用负责。发现密钥泄露或未经授权的使用时，应立即在控制台停用或删除相关密钥，并联系上述邮箱。不得使用他人凭证、转让他人账户、规避权限、限流、计费或安全控制。客服不会索取密码、可用 API 密钥或验证码。
## 3. 模型与生成内容
可用模型、模型 ID、接口协议、价格与计费单位以[模型目录](https://open.scenepond.ai/zh/models)和付款或调用前显示的配置为准。本站连接第三方模型服务，不宣称是模型厂商官方平台或获得其背书。模型、功能和上游可用性可能调整；无法支持的协议不应视为已承诺提供。
生成内容可能不准确、重复、有偏见或不适合特定目的。用户应自行核查输出，不得将其直接作为医疗、法律、金融等专业判断的唯一依据。用户须具有提交输入、参考素材、肖像、声音、商标和受保护作品所需的权利，并在使用或发布输出前审核其合法性与准确性。本站不保证输出独占、必然准确或不侵犯第三方权利。
用户保留其输入中依法享有的权利；仅授权本站及承接所选模型的服务方处理完成请求所需的内容。输出的权利受适用法律、输入权利及相关上游模型条款约束，本协议不授予本站或用户并未拥有的第三方权利。
## 4. 充值、扣费与退款
本服务采用一次性预付余额及按量扣费，不因单次充值而开通自动续费或自动充值。付款前显示充值金额，最终金额、币种及适用税费以结账页为准；选择 Pancake 时由 Waffo Pancake 处理支付。余额仅用于本站 API 服务，不是银行存款，不计息，不提供用户间现金转账。
已购买余额不设置自动到期日。使用量和扣费以请求对应的价格配置及账户使用记录为依据，计费单位见[计费说明](https://open.scenepond.ai/zh/pricing)。价格调整适用于调整后发起的请求，不追溯改变已经完成的请求扣费。开始使用前应检查模型价格及余额。
充值成功后 7 天内，若该笔充值尚未用于付费 API 请求，可申请全额退款。重复支付、错误扣款、未入账及服务结算争议按[退款政策](https://open.scenepond.ai/zh/refund-policy)核查。正常计费且已消耗的余额通常不退款，法律规定的不可放弃权利除外。账户关闭时，可向客服申请核查尚未消耗的购买余额；运营者终止整个服务时，应就未交付服务对应的购买余额安排退款。赠送额度不作为现金购买金额退还。
## 5. 禁止行为与处置
[内容使用政策](https://open.scenepond.ai/zh/acceptable-use)适用于所有启用模型、输入、参考素材及输出。禁止色情与非自愿私密影像、极端血腥和暴力煽动、仇恨、儿童性虐待及未成年人性化、欺诈性深度伪造或冒充、版权和商标侵权。亦禁止诈骗、骚扰、泄露他人私密资料、攻击服务以及绕过安全控制。
发现违规、账户被盗或重大安全风险时，可拒绝请求、限制访问、暂停密钥或账户，并在可控制范围内移除违规内容。一般问题可要求整改；严重危害或依法要求时可立即采取限制。用户可向客服提供请求 ID 与说明提出申诉。处置不当然没收购买余额，也不排除强制性退款或数据权利。违法线索按适用法律处理。
## 6. 可用性、责任与争议
维护、上游故障、网络问题、配额及不可抗力可能影响服务。本服务不承诺始终无故障、固定响应时间或特定生成效果。因可核查的错误扣费或未交付服务产生的问题，按退款政策纠正；客服可协助排查可定位的问题。
在适用法律允许的范围内，运营者不对用户未经核查使用生成结果所造成的间接损失、利润损失或第三方行为承担保证责任。法律不允许排除的责任，以及欺诈、故意或重大过失导致的责任，不因本协议而被免除。
争议请先通过客服协商；协商不成，可向依法具有管辖权的法院或主管机构寻求救济。本协议不剥夺用户居住地适用法律给予的强制性消费者权利。重大条款变更会通过网站或账户通知披露，注明生效时间，不追溯改变已完成订单条件。

# Scenepond API Terms of Service

## 1. Service, operator and contact
Scenepond API is an AI model API access service operated by an individual at https://open.scenepond.ai. Contact support or report abuse at [api-support@scenepond.ai](mailto:api-support@scenepond.ai). These terms govern this API service, its accounts and one-time balance purchases. Main-site Scenepond canvas products, subscriptions and credit packages are separate products.
You must be at least 18 and able to enter a contract. You must have authority to act for an organization you represent. Read these terms, the [Privacy Policy](https://open.scenepond.ai/en/privacy-policy), [Refund Policy](https://open.scenepond.ai/en/refund-policy) and [Acceptable Use Policy](https://open.scenepond.ai/en/acceptable-use) before registration or use. Do not register or use the service if you do not agree.
## 2. Accounts and API keys
Provide accurate account information and protect passwords, sessions and API keys. You are responsible for authorized activity through your account. If credentials are exposed or used without authorization, disable or delete affected keys in the console and contact support. Do not misuse another person's credentials, transfer another person's account, or evade access, rate, billing or safety controls. Support never requests passwords, usable API keys or verification codes.
## 3. Models and generated results
Available model IDs, protocols, rates and billing units follow the [model catalog](https://open.scenepond.ai/en/models) and configuration shown before payment or use. We connect third-party model services and do not claim official status or endorsement from model developers. Models, features and upstream availability may change. Unsupported protocols are not promised capabilities.
AI results may be inaccurate, duplicated, biased or unsuitable. Review results and do not use them as the sole basis for medical, legal, financial or other professional decisions. Obtain rights needed for inputs, reference material, likenesses, voices, brands and protected works. Review outputs before use or publication. We do not guarantee exclusive, accurate or non-infringing outputs.
You retain rights you lawfully hold in inputs and authorize only the processing needed to complete your requests by us and the services handling your selected model. Output rights depend on applicable law, input rights and relevant upstream model terms. These terms do not grant third-party rights that neither party holds.
## 4. Payments, usage and refunds
The service uses one-time prepaid balance and usage deductions. A purchase does not authorize subscriptions, automatic renewal or automatic top-ups. The purchase amount is shown before payment; final amount, currency and applicable taxes appear at checkout. Waffo Pancake processes payments when Pancake is selected. Balance is for this API service, is not a bank deposit, earns no interest and cannot be transferred as cash between users.
Purchased balance has no automatic expiry. Usage deductions follow the request's configured rate and account usage records; see the [billing guide](https://open.scenepond.ai/en/pricing). Rate changes apply to later requests and do not retrospectively alter completed usage. Check rates and balance before use.
A purchase unused for paid API calls is eligible for a full refund requested within seven days of successful payment. Duplicate payments, incorrect deductions, missing credits and settlement disputes are reviewed under the [Refund Policy](https://open.scenepond.ai/en/refund-policy). Properly billed and consumed balance is generally non-refundable, subject to non-waivable legal rights. On account closure, contact support to review unused purchased balance. If the operator discontinues the entire service, refunds will be arranged for purchased balance corresponding to undelivered service. Promotional credits are not refunded as cash purchases.
## 5. Prohibited use and enforcement
The [Acceptable Use Policy](https://open.scenepond.ai/en/acceptable-use) applies to every enabled model, input, reference and output. Pornography and non-consensual intimate imagery, extreme gore and violent incitement, hate, child sexual abuse and sexualization of minors, deceptive deepfakes or impersonation, and copyright or trademark infringement are prohibited. Fraud, harassment, disclosure of private data, attacks on the service and bypassing safety controls are also prohibited.
For violations, compromised accounts or serious safety risks, requests may be rejected, access restricted, keys or accounts suspended, and content within our control removed. Remediation may be requested for ordinary issues; immediate restrictions may be necessary for serious harm or legal requirements. Appeal by contacting support with the request ID and explanation. Enforcement does not automatically forfeit purchased balance or remove mandatory refund or data rights. Suspected unlawful activity is handled under applicable law.
## 6. Availability, responsibility and disputes
Maintenance, upstream failures, network problems, quotas and events beyond our control may affect service. Continuous availability, fixed response times and particular generation results are not guaranteed. Verifiable incorrect charges or undelivered service are addressed under the Refund Policy; support can assist with locatable issues.
Where permitted by law, the operator does not warrant against indirect losses, lost profits or third-party conduct arising from use of unverified results. Liability that cannot lawfully be excluded, including applicable liability for fraud, intent or gross negligence, remains unaffected.
Please first seek resolution through support. Unresolved disputes may be brought before a legally competent court or authority. Mandatory consumer protections applicable where you live are preserved. Material changes will be disclosed through the site or account notices with an effective date and will not retrospectively alter completed orders.
